These terms govern your use of the marketing website operated by Spark Education Ltd ("Spark", "we", "us"), registered office 86–90 Paul Street, London, EC2A 4NE. By accessing the site you agree to these terms. If you do not agree, please do not use the site.

Definitions

  • Site means this marketing website and its content.
  • Product means the Spark attendance and engagement software.
  • You means the visitor or organisation accessing the Site.

Use of the website

You may use the Site for lawful purposes only. You agree not to misuse it — including attempting to gain unauthorised access, interfering with its operation, scraping at scale, or uploading malicious code or unlawful content.

The website vs the product

These terms apply to the Site only. Access to and use of the Product is governed by a separate Master Services Agreement and order form between Spark and the customer, together with our Data Processing Addendum. Nothing on the Site forms a binding offer to supply the Product.

Intellectual property

All content on the Site — text, design, logos and graphics — is owned by or licensed to Spark and protected by intellectual-property laws. You may not reproduce or redistribute it without our written permission.

No warranty

The Site is provided on an "as is" and "as available" basis. We make no warranties that it will be uninterrupted, error-free or that the information on it is complete or current.

Limitation of liability

To the fullest extent permitted by law, Spark is not liable for any indirect or consequential loss arising from your use of the Site. Nothing in these terms excludes liability that cannot lawfully be excluded.

Third-party links

The Site may link to third-party websites. We do not control and are not responsible for their content or practices.

Changes to these terms

We may update these terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.

Governing law

These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction over any dispute.
